Blaze Robin — Landmark civil litigation is unfolding in Los Angeles between plaintiff, K.G.M., and defendants, Meta and Google, signaling a doctrinal shift in how courts treat social media companies. K.G.M., a California woman, is alleging that Meta’s Instagram and Google’s YouTube harmed her mental health as a child due to the platforms’ addictive compositions. Specifically, she is claiming she began using both platforms as a child and became addicted to both. As to the defendants’ liability, she argues that both platforms were specifically designed to addict minors, herself included. As a result of her addiction, which she claims the defendants orchestrated, her mental health suffered causing depression, disruption in school performance, loss of sleep, and a stunted social life.
Notably, Snap and TikTok were originally included as defendants but they both reportedly settled. The claims against Snap and TikTok were similar to the ones brought against Meta and Google. K.G.M. is now asking a jury to award her monetary recovery from the defendants, while Meta and Google are both defending their actions.
Unlike traditional lawsuits against social media companies which target specific user content, K.G.M’s case frames the alleged harm as stemming from the design and operation of the platforms themselves. This strategy could weaken social media companies’ long-standing shield of Section 230 of the Communications Act––which affords these companies protection from cases arising out of third party content––and instead expose social media giants to civil liability more akin to product defect claims.
Section 230 states that no provider of an interactive computer service will be treated as the “publisher or speaker” of information provided by another information content provider. This provision has historically immunized platforms from civil liability for user-made content. Courts have relied on Section 230 to dismiss countless suits that sought to hold platforms responsible for harmful content posted by their users. For decades, social media companies largely avoided tort liability by showing that alleged harms stemmed from others’ content, not their own actions as platforms.
Meta’s CEO, Mark Zuckerberg, testified that Meta does not knowingly permit users under thirteen on Instagram and that the company has updated their safety features and policies. But internal documents presented at trial, including a 2018 Instagram presentation stating, “[i]f we want to win big with teens, we must bring them in as tweens,” suggest internal strategies focused on younger users. Importantly, the lawsuit at issue is not about specific posts by other users but rather focuses on the architecture of the platforms. Rather than claiming any specific user made post caused K.G.M.’s injuries, she claims that the platforms’ features, such as infinite scroll, are actually the cause of her injuries. This difference in framing is central to the potential legal shift at stake.
At its core, K.G.M’s case tests whether digital platforms should be treated as interactive services protected from liability for third-party user content, or as products whose engineered characteristics can form the basis of liability when they allegedly cause harm.
At trial K.G.M. is advancing a product design theory of liability, rather than attacking individual posts or user interactions. K.G.M. is alleging that the functionality of the social media applications themselves was intentionally engineered to maximize engagement, even at the expense of minors’ well-being. Shifting the focus to design, rather than content, matters because Section 230’s protections apply to a platform’s role as a publisher of third-party content. If the harm is instead alleged to arise from inherently addictive product elements, plaintiffs argue that the platforms are acting more like manufacturers of a defective consumer product than neutral intermediaries. This strategy mirrors product liability litigation in other contexts, where harm allegedly results from how something was designed or marketed, similar to cigarette and opioid litigation.
Under this theory, Meta’s internal documents acknowledging engagement goals and age verification challenges could support a link between design decisions and the alleged harms. This argument could bring these claims outside the traditional scope of Section 230’s immunity.
If the jury sides with K.G.M. and awards damages, the result could reverberate far beyond this individual case. A verdict grounded in product design liability could weaken Section 230 defenses––insulating the companies from liability arising out of user made posts––whereby courts may be more willing to allow cases to proceed when plaintiffs allege harm from design rather than content. Social media companies may see increased litigation risks where civil suits alleging defect-like harms could become the norm, especially in youth and mental health contexts. These same companies could be forced to change their product development practices by altering how they design engagement features, especially for minors, to avoid liability. Finally, looking ahead, tech giants may need to reevaluate internal risk assessments, safety programs, and disclosures to their investors.
While these arguments are still novel, they are only novel to social media companies. If plaintiffs are to begin their quest for recovery under a theory of product liability, they need look no further than the history of tobacco and opioid litigation. There advocates successfully argued that the products, tobacco and opioids, were defective in that they encouraged addictive behaviors that caused harm to the users. Inversely, tech giants, such as Meta and Google, should understand the potential danger their business model, and possibly their industry as a whole, faces. The change in strategy could bring about long-term changes in their business strategies. The Meta addiction trial is much more than a high-profile courtroom drama, it is a potential inflection point in the law governing digital platforms. By recasting alleged harms as byproducts of platform design rather than content publication, plaintiffs are challenging the traditional boundaries of Section 230 immunity and probing whether modern tech giants can be held accountable under different civil liability principles. The outcome will matter not just to Meta and Google, but to every company operating social media platforms, as this may be a change in how the law allocates risk and responsibility in the digital age.
